Terms of Service

By accessing or using CabinyVacations.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Platform. These Terms constitute a legally binding agreement between you and CabinyVacations LLC ("Company," "we," "us," or "our").

CabinyVacations is an online marketplace that connects property owners ("Hosts") with travelers ("Guests") seeking short-term rental accommodations in the North Georgia Mountains region. We do not own, manage, or control any listings. We act solely as a platform facilitating connections between Hosts and Guests.

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding contract.

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Hosts are solely responsible for their listings, including accuracy of descriptions, pricing, availability, and compliance with all applicable local laws, zoning regulations, HOA rules, and short-term rental ordinances. Hosts must maintain adequate insurance coverage. CabinyVacations charges a service fee of 8% on each completed booking, deducted automatically from the Host payout.

Guests agree to use listed properties only for their stated purpose and to treat properties with care. Guests are responsible for any damage caused during their stay beyond normal wear and tear. Guests must comply with all house rules set by the Host. Unauthorized parties, smoking where prohibited, and bringing undisclosed pets are grounds for immediate removal without refund.

All payments are processed through our secure payment partner, Stripe. By making a booking, you authorize us to charge your payment method for the total amount shown at checkout, including nightly rate, cleaning fee, and applicable taxes. Payouts to Hosts are issued within 24 hours of Guest check-in, subject to verification.

Cancellation terms vary by listing and are set by the Host. The applicable policy is displayed on each listing page and at checkout. CabinyVacations service fees are non-refundable once a booking is confirmed. Guests are encouraged to purchase travel insurance for additional protection.

Both Hosts and Guests may leave reviews after a completed stay. Reviews must be honest, accurate, and comply with our Content Guidelines. We reserve the right to remove reviews that violate these guidelines. Retaliatory or coerced reviews are prohibited.

You agree not to:

• Use the Platform for any unlawful purpose
• Post false, misleading, or fraudulent listings
• Circumvent the Platform to conduct off-platform transactions
• Harass, threaten, or discriminate against other users
• Scrape, crawl, or otherwise extract data from the Platform without permission
• Attempt to gain unauthorized access to any part of the Platform

All content on the Platform, including text, graphics, logos, and software, is the property of CabinyVacations LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

To the maximum extent permitted by law, CabinyVacations LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to property damage, personal injury, or financial loss. Our total liability to you shall not exceed the amount of fees paid by you to us in the 12 months preceding the claim.

Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Fulton County, Georgia. You waive any right to a jury trial or class action proceeding.

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law provisions.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.
